UAE Gratuity Calculation Rules

Under the UAE Labour Law, gratuity is generally calculated as follows:

  • Employees must complete at least one year of continuous service to become eligible for gratuity.
  • Gratuity is calculated using the employee’s last drawn basic salary, not the total salary.
  • For the first five years of service, gratuity is generally calculated at 21 days’ basic salary for each completed year.
  • For service exceeding five years, gratuity is generally calculated at 30 days’ basic salary for each additional year.
  • The total gratuity should not exceed two years’ basic salary, subject to applicable legal provisions.
